Chilubaís judgement postponed to August

Judgement in former president Fredrick Chiluba' s cases has been deferred to August 14, 2009.

This is to allow the court to study the late written submissions by the former president's lawyers.

Judgement was supposed to be delivered next Monday, July 20, 2009.

This is in the case where Dr. Chiluba is jointly charged with two directors of the defunct Access Financial Service (AFS), Faustin Kabwe and Aaron Chungu in a case involving 500 thousand US dollars (US$$$500,000).

The case is heard by Ndola High Court Deputy Registrar, Jones Chinyama, sitting as magistrate in Lusaka.

The court had set April 24 as the date by which the defence should present to court their written submissions. But Dr. Chiluba's team had failed to present the submisions prompting the court to threaten to deliver judgment without the submissions.

But last week, the state agreed to allow Dr. Chiluba to file in his written submissions.

Attorney-general Mumba Malila agreed with Dr. Chiluba's lawyer Robert Simeza that the submissions can be filed and considered in view of the ruling set for July 20.

But today, Friday, the case came up in chambers at the instigation of the court. Principle resident Magistrate Charles Kafunda heard the case on behalf of behalf of magistrate Chinyama.
