Lusaka High Court Sets Hearing Date In M'membe's Judicial Review Hearing
The Lusaka High Court has set September 15th 2009 as hearing date of
the judicial review being sought by Post
Newspapers' editor-in-chief Fred M'membe.
This is in a case in Which
M'membe applied for judicial review following the issuance of a bench warrant
for his arrest. High court Judge Albert Wood granted the
application and has also stayed contempt proceedings against M'membe, United
States based columnist Muna Ndulo and Post Newspapers' deputy editor-in-chief
M'membe and his co accused persons sought judicial review to
have chief resident Magistrate Charles Kafunda's ruling quashed.
Wednesday September 2nd 2009 Magistrate Kafunda issued a bench
warrant of arrest against M'membe following his ignoring of court summons.
But in their affidavit filed in the high court the complainants are arguing that
Magistrate Kafunda violated sections 98 and 100 of the criminal procedure code
